In January, 1909, Уthe defense lawyers petitioned the U.S. Supreme Court to reopen the caseФ for the Cuban Five. УThousands of messages, from all over the world, including twelve amicus briefs (one of them from ten Nobel Laureates) -- petitioned the Supreme Court to review the case.Ф In private talks to Obama, Jimmy Carter urged him to release the Cuban citizens. But in June, Уthe Supreme Court rejected the case without explanation.Ф __________________ Costa: УCuddy argues that the five could not receive a fair trial in Miami, Сa city seething with hostility,Т but that and other feeble objections to conviction were considered and dismissed to the by the court.Ф Cuddy: УDespite several pleas for an impartial venue, the Court rejected the defense lawyersТ request. On June 8, 2001, the Cubans were convicted and punished with draconian sentences: Gerardo Hernandez, Antonio Guerrero, Rabin Labanibo life sentences; brothers Fernando and Rene Gonzalez, 18 and 15 years respectively.Ф УIn August, 2005, the 11th Circuit Court of Appeals, ruled unanimously to reverse the convictions and ordered a new trial. Unfortunately, the 11th Circuit Court in full session reinstated the convictions. However, the Circuit Court left behind a damning brief exposing government misconduct on several accounts.Ф * Refusal of venue change. УAfter considering opinion polls, newspapers, and sociological studies, the three judges concluded that the entire Miami-Dade community was Сrepeatedly and deeply exposedТ to prejudicial publicity. Dubbing Miami as a СCuban enclave,Т sociologist Lisandro Perez claimed that Сthe possibility of selecting twelve [impartial] citizens,Т even non-Cubans, was Сvirtually zero.Т Moreover, the jurors were harassed by groups, pressuring them to avoid reaching Сa verdict unfavorableТ to the militants.Ф * DefendantsТ mission. УThere was no evidence confirming the defendants had spied on the U.S. government. Rather, the judges pointed toward the Cuban exile groups involved in Сthe terrorist actions against CubaТ while implying that the defendantsТ objectives were to expose and stop the assaults on their homeland.Ф * Prosecutorial Misconduct. УThe prosecutor had demonized the defendants as spies Сsent to . . . destroy the United StatesТ while warning the jurors that an acquittal would betray their community. Mincing no words, the appellate judges criticized the prosecutor for statements Сinflaming the juryТs prejudicesТ-- a УreprehensibleФ violation of her oath of office.Ф УTheir conclusion: the Сconvictons are REVERSED and we REMAND for a new trial.Т As we have seen, however, the Court in full sesson reversed the reversal, keeping the Cubans in chains.Ф _______________ Costa: УWhere is CuddyТs sympathy for Cuban-Americans whose families have been held hostage . . . its populace enslaved its populace in tyranny.Ф Cuddy: Costa misses the point Ц when he claims I am aiding and abetting CastroТs tyranny. Rather he is trying to prevent Washington from stomping on the its own laws, its democratic principles, and our Constitution which promised to Уform a more perfect Union, establish Justice . . . .Ф The issue is not CastroТs tyrannical regime, but a fair trial in a neutral venue. If Costa wants to define the Cuban-American paramilitaries as freedom fighters, at least he should recognize that they have resorted to terrorist attacks on the Cuban people Ц 3,478 killed by 1998. Ring leader Luis Posada, now living safely in Miami, is notorious for his role in bombing a Cuban airliner murdering 73 people (1976), and sabotaging CubaТs fledging tourist economy in the 1990Тs targetting hotels, airports and other tourist places. ╫▌╓▌ў ч ю H J ┴ ├ q r v Н ЕЙЭ╚╦ф+, в깤¤√¤¤∙∙√¤√¤√¤√¤¤H*5Б>*W│╒╓╫}╒╓ў ц ч / 0 q r ├ ЕЖ╘╟╚;<√ ¤¤¤¤°°°°¤¤°°°¤°¤ЄЄЄЄЄ¤¤¤¤¤¤°Д<^Д<$a$№■ бвїM▀стцъыьэюяЁёЄєЇїЎў°∙·√№····························$a$ 1Рh░╨/ ░р=!░"░#Ра$Ра%░ i8@ё 8 NormalCJ_HaJmH sH tH <A@Є б< Default Paragraph Font№     !  аzЩ!  аzЩ╚ №s№ № №^fЪбqv╬╓ЙСV ` ╝ ┬ % ж░■`f╝╛▀Ёч∙0?├╧ ╘ ┘ ╦ ф = N ї № MP■::::::::::::  William JungelsUMacintosh HD:Users:bill:Documents:Microsoft User Data:AutoRecovery save of letter re William Jungels0Macintosh HD:Documents:dreamweaver:lasc:rebuttal @А√√d╨Й√√iI№P @GРTimes New Roman5РАSymbol3Р Arial"qИЁ╨hN[√жN[√ж│█·ЖtЙv!Ёа┤┤ББ202 М3ГЁHP  9 The Cuban Five: An American Tragedy NED CUDDYWilliam Jungels■  рЕЯЄ∙OhлС+'│┘0╝ШафЁ, DP l x Д РЬдм┤': The Cuban Five: An American Tragedyv NED CUDDY ED ED NormalDWilliam Jungels2llMicrosoft Word 10.1@F├#@к2└сФ╠@dgпЭа╠@dgпЭа╠t■  ╒═╒Ь.УЧ+,∙о0 hp|ДМФ Ьдм┤ ╝ ' 2 : The Cuban Five: An American Tragedy Title ■   ■    ■   "#$%&'(■   ¤   +■   ■   ■                                                                                                                                                                                                                                                                                                                                           Root Entry         └FАy╜╩sа╠-А1Table            WordDocument        " SummaryInformation(    DocumentSummaryInformation8            !CompObj    XObjectPool            Аy╜╩sа╠Аy╜╩sа╠            ■                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                           ■      └FMicrosoft Word Document■   NB6WWord.Document.8
